FCMM Version 54
Software License &
Authorized Use Policy
Temporary limited-use terms for First Class Meal Manager.
1. Ownership and Intellectual Property
First Class Meal Manager (“FCMM,” the “Software,” or the “Application”) is the property of Bradford D. Smith. All applicable copyrights, trademarks, trade dress, interface designs, source code, object code, documentation, graphics, workflow concepts, branding, and other intellectual-property rights are reserved by the owner except where third-party materials are separately identified.
Design and development of FCMM have been undertaken in partnership with MUIDEM Technologies LLC and Azure Avifuana Holdings. Nothing in this policy transfers ownership of FCMM or any associated intellectual property to a user, tester, airline, operator, employer, or other third party.
2. Temporary Limited License
Subject to this policy, the owner grants an eligible user a temporary, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use FCMM solely for authorized testing, evaluation, personal operational organization, feedback, and other expressly permitted purposes.
The license does not constitute a sale of the Software and does not grant the user any ownership interest in FCMM.
3. Authorized Users
FCMM is intended for Flight Crew who hold an FAA Certificate and who have been granted access by the owner or an authorized representative. Access may be suspended or revoked at any time.
4. Permitted Use
- Testing and evaluating FCMM features and workflows.
- Using FCMM as a personal organizational aid in a manner permitted by the user’s employer, operator, applicable manuals, and governing regulations.
- Providing feedback, bug reports, feature requests, and operational observations to support continued development.
- Installing the authorized version on devices personally used by the licensed user, subject to any access limitations communicated by the owner.
5. Prohibited Use
- Copying, republishing, redistributing, reselling, renting, leasing, or sublicensing FCMM or access to FCMM.
- Reverse engineering, decompiling, disassembling, scraping, extracting, cloning, or attempting to derive or reproduce source code, proprietary logic, design systems, or protected application assets except where such restriction is prohibited by applicable law.
- Removing, modifying, hiding, or misrepresenting copyright, trademark, ownership, attribution, or license notices.
- Using FCMM outside the authorized scope, for unauthorized commercial distribution, or in a manner that violates law, regulation, employer policy, or operator procedures.
- Representing FCMM as an official airline, FAA, operator, or employer system unless an express written agreement states otherwise.
- Using FCMM to unlawfully collect, retain, disclose, or transmit passenger, employee, proprietary, confidential, or regulated information.
6. Operational and Safety Disclaimer
FCMM is an independent supplemental workflow tool. It is not a substitute for required training, company manuals, official airline systems, dispatch information, safety procedures, regulatory requirements, crewmember instructions, or the exercise of professional judgment.
Users must follow all applicable laws, FAA requirements, operator manuals, employer rules, safety procedures, and instructions from authorized personnel. Where FCMM conflicts with an official source or required procedure, the official source and required procedure control.
7. Data and Device Responsibility
FCMM may store operational information locally on the user’s device. The user is responsible for securing the device, controlling access, using available security settings, protecting confidential information, and complying with any employer or operator rules concerning electronic devices and information handling.
8. Testing Software; No Warranty
FCMM may be provided for testing, evaluation, early access, or pre-release use. Features may change, be interrupted, contain defects, or be withdrawn. To the maximum extent permitted by law, the Software is provided “as is” and “as available,” without warranties of uninterrupted operation, fitness for a particular purpose, merchantability, accuracy, or non-infringement.
9. Limitation of Use and Responsibility
Users are responsible for independently verifying information and for all actions taken while using FCMM. The owner and development partners are not responsible for an airline’s or employer’s authorization of the Software, and a license to FCMM does not itself grant permission to use personal software during any particular duty assignment or operation.
10. Termination
The temporary license may be terminated or revoked at any time. Upon termination, the user must stop using FCMM and remove authorized copies when instructed, subject to any legally required data-retention obligations.
11. Changes to This Policy
The owner may update these terms as FCMM develops. Continued use after an updated policy is made available constitutes acceptance to the extent permitted by law.
12. Reservation of Rights
All rights not expressly granted in this policy are reserved by Bradford D. Smith. © 2026 Bradford D. Smith. All rights reserved.
